Huge halo may hold missing matter
The Milky Way galaxy is cocooned inside an enormous cloud of hot gas, a finding that could solve a persistent astrophysical conundrum. Heated to more than 1 million degrees Celsius, the halo extends more than 300,000 light-years from the galactic center and contains at least as much mass as 10 billion suns, scientists report in the Sept. 1 Astrophysical Journal Letters. An international team of astronomers used NASA?s orbiting Chandra X-ray Observatory to detect hot, charged oxygen atoms. If verified, the halo?s size could solve what?s been called the ?missing baryon? problem: In the Milky Way and local neighborhood, at least half the expected baryons???normal subatomic particles like protons and neutrons???are unaccounted for. Comet could dazzle or fizzle
The skies might blaze with a visitor shining more brightly than the moon beginning in November 2013. A large comet, called C/2012 S1, was discovered September 21 by the International Scientific Optical Network in Russia and confirmed September 24 by the International Astronomical Union?s Minor Planet Center in Cambridge, Mass. Also called Comet ISON, the icy traveler is currently outside the orbit of Jupiter and in the constellation Cancer, heading for a close encounter with the sun. As it whizzes by the sun, the comet?s frozen ingredients could evaporate and leave behind a long, spectacular tail???if it doesn?t begin breaking up before then. Though predicting cometary orbits is easy, predicting brightness is trickier, because that depends on how a comet behaves. Life could have been brought to Earth aboard rocky chunks ejected from neighboring planetary systems. The idea, called lithopanspermia, is often viewed with derision or incredulity???but conditions in the early solar system may have been just right for such a thing to occur, Amaya Moro-Mart?n of Spain?s Centro de Astrobiolog?a reported at the European Planetary Science Congress in Barcelona on September 25. After considering the dynamic environment in the very young solar system and its proximity to neighboring planetary systems, Moro-Mart?n and colleagues concluded that life-bearing materials could be efficiently exchanged between systems if interstellar rocks traveled at slow speeds. LOS ANGELES (AP) ? The NASA rover Curiosity has beamed back pictures of bedrock that suggest a fast-moving stream, possibly waist-deep, once flowed on Mars ? a find that the mission's chief scientist called exciting.
There have been previous signs that water existed on the red planet long ago, but the images released Thursday showing pebbles rounded off, likely by water, offered the most convincing evidence so far of an ancient streambed.
There was "a vigorous flow on the surface of Mars," said chief scientist John Grotzinger of the California Institute of Technology. "We're really excited about this."
The discovery did not come as a complete surprise. NASA decided to plunk Curiosity down inside Gale Crater near the Martian equator because photos from space hinted that the spot possessed a watery past. The six-wheeled rover safely landed Aug. 5 after a nail-biting plunge through the Martian atmosphere. It's on a two-year, $2.5 billion mission to study whether the Martian environment could have been favorable for microbial life.
Present day Mars is a frozen desert with no hint of water on its radiation-scarred surface, but geological studies of rocks by previous missions suggest the planet was warmer and wetter once upon a time.
The latest evidence came from photos that Curiosity took revealing rounded pebbles and gravel ? a sign that the rocks were transported long distances by water and smoothed out.
The size of the rocks ? ranging from a sand grain to a golf ball ? indicates that they could not have been carried by wind, said mission scientist Rebecca Williams of the Planetary Science Institute in Tucson, Ariz.
Though Curiosity did not use its high-tech instruments to drill into the rocks or analyze their chemical makeup, Grotzinger said scientists were sure that water played a role based on just studying the pictures.
It's unclear how long the water persisted on the surface, but it easily could have lasted "thousands to millions of years," said mission scientist Bill Dietrich of the University of California, Berkeley.
Curiosity chanced upon the dried-up streambed while driving to Glenelg, an intriguing spot where three types of terrain meet. Its ultimate destination is Mount Sharp, a mountain rising from the center of crater floor, but it was not expected to travel there until the end of the year.
Finding past water is a first step toward learning whether the environment could have supported microbes. Scientists generally agree that besides water and an energy source such as the sun, organic carbon is a necessary prerequisite for life.
While an ancient streambed holds promise as a potentially habitable environment, scientists don't think it's a good place to preserve the carbon building blocks of life. That's why the rover will continue its trek to the foothills of Mount Sharp where there's a better chance of finding organics.

Gas Training Excellence
Kier is leading the way in providing valuable gas engineering careers and training after announcing 6,096 candidates have successfully qualified through its UK training centres.
The leading construction, services and property group marked Gas Safety Week (10-16 September) by celebrating the achievements of its state-of-the-art domestic and commercial gas training centres over the last ten years.
Kier?s first Gas Technical Training Centre opened in Sheffield in 2001 to fulfil the training needs of Kier staff from across the region, before expanding to cater for external trainees from around the city. Male DNA commonly found in women?s brains, likely from prior pregnancy with a male fetus
ScienceDaily (Sep. 26, 2012) ? Male DNA is commonly found in the brains of women, most likely derived from prior pregnancy with a male fetus, according to first-of-its-kind research conducted at Fred Hutchinson Cancer Research Center. While the medical implications of male DNA and male cells in the brain are unknown, studies of other kinds of microchimerism -- the harboring of genetic material and cells that were exchanged between fetus and mother during pregnancy -- have linked the phenomenon to autoimmune diseases and cancer, sometimes for better and other times for worse.
The study findings are published Sept. 26 in PLOS ONE. Lead author William F. N. Chan, Ph.D., in the Department of Biochemistry at the University of Alberta, conducted the research while working in the Hutchinson Center laboratory of J. Lee Nelson, M.D., a member of the Center's Clinical Research Division and a leading international authority on microchimerism. Nelson is senior author on the paper.
Chan said the study is the first description of male microchimerism in the female human brain. The findings support the likelihood that fetal cells frequently cross the human blood-brain barrier and that microchimerism in the brain is relatively common. Until this study, it was not known whether these cells could cross the barrier in humans. For this research, scientists examined brain autopsy specimens from 59 women who had died between the ages of 32 and 101. Male microchimerism was detected in 63 percent of subjects, was distributed in multiple brain regions and was potentially persistent throughout the human lifespan; the oldest female in whom male fetal DNA was detected in the brain was 94.
Twenty six of the women had no neurological disease and 33 had Alzheimer's disease. The brains of women with Alzheimer's had a somewhat lower prevalence of male microchimerism, which appeared in lower concentrations in regions of the brain most affected by the disease. However, the authors noted that the small number of subjects and largely unknown pregnancy history of the women means a link between Alzheimer's disease and level of male cells of fetal origin cannot be established.
The study also does not provide an association between male microchimerism in the female brain and relative health versus disease. "Currently, the biological significance of harboring male DNA and male cells in the human brain requires further investigation," Chan said.
However, other Hutchinson Center studies of male microchimerism in women have found it to impact a woman's risk of developing some types of cancer and autoimmune disease. In some conditions, such as breast cancer, cells of fetal origin are thought to confer protection; in others, such as colon cancer, they have been associated with increased risk. Hutchinson Center studies also have linked lower risk of rheumatoid arthritis to women who previously had given birth at least once as compared to nulliparous women. Grants from the National Institutes of Health and the Canadian Institutes of Health Research funded the study, which also involved researchers from the Department of Pathology and Division of Rheumatology at the University of Washington School of Medicine.

New law lets astronauts keep artifacts
America's early space pioneers and moon voyagers have now been confirmed as the legal owners of the equipment and spacecraft parts they saved as souvenirs from their missions.
President Barack Obama on Tuesday signed a bill into law granting NASA's Mercury, Gemini and Apollo crew members "full ownership rights" to the artifacts they received and retained more than 40 years ago.
The legislation (H.R. 4158) was authored in response to recent challenges raised by NASA's General Counsel and Office of Inspector General (OIG) over the attempted sale by several astronauts of their mementos. The issue came to a head in January after an inquiry by the space agency put a hold on the almost $400,000 auction of a checklist used by Apollo 13 commander James Lovell.
The bill clarifies what NASA Administrator Charles Bolden described as "fundamental misunderstandings and unclear policies."

"NASA is pleased ownership of flight mementos and other artifacts of the Mercury, Gemini and Apollo astronauts is no longer in question," NASA spokesman Robert Jacobs said in a statement issued on Wednesday. "We appreciate the expeditious consideration by Congress to clarify ownership of these mementos and the patience of the astronauts, museums, learning institutions, and others who have these artifacts (from) the astronauts in personal and private collections." Ambiguity over astronauts' artifacts
"This bill seeks to eliminate any further ambiguity about Apollo-era artifacts that were received by the astronauts. It simply says that astronauts who flew through the end of the Apollo program will be granted full right of ownership of any artifacts received from their missions," Rep. Ralph Hall (R-Texas), chairman of the House of Representatives' Science, Space and Technology Committee, said.
Hall, joined by ranking committee member Eddie Bernice Johnson (D-Texas), introduced the bill in March. It was passed by the House Sept. 19. The Senate approved the bill three days later during the pre-dawn hours of Sept. 22, prior to leaving on recess.
The question behind the legislation, if astronauts hold the rights to expendable space equipment ? including their checklists, personal hygiene kits, and items that, had they been left aboard the Apollo lunar module would have been crashed into the moon ? had gone largely uncontested by NASA until last year.
Then, in a series of challenges, including a lawsuit brought against Edgar Mitchell, who was the sixth man to walk on the moon, NASA counsel began to insist that if paperwork couldn't be produced documenting that the equipment had been released to the astronaut, then it was not legally his to own, donate or sell.
In Mitchell's case, the government sought the return of the data acquisition camera (DAC) that he saved from being destroyed on the moon. Ultimately, Mitchell settled out of court, agreeing to turn the camera over to the Smithsonian for its display.
NASA's General Counsel then raised questions about the title to artifacts sold in January by a Dallas auction house on behalf of James Lovell and Apollo 9 spacewalker Rusty Schweickart. One item in particular, a checklist that had been used to reconfigure the lunar module into a lifeboat on the periled Apollo 13 mission, made headlines after it sold for a record-setting $388,375.
Heritage Auction Galleries put the sale on hold after NASA challenged the astronauts' ownership. In response, Lovell, Schweickart and other Apollo astronauts met with Bolden at NASA Headquarters in Washington, D.C., to defend their "good faith" actions.
The astronauts maintained that their managers had given them permission to keep the equipment at the time of their flights, but as the focus was on flying the missions, there was little, if any, documentation produced in support of the equipment being transferred to their property.
In the years since they flew, the astronauts donated many of the artifacts to museums and organizations, as well as sold items to collectors, which were at potential jeopardy if the legislation had not been passed.
Certain astronauts, certain artifact
The bill, which in its final form is about a third the length of this article, succinctly defines what type of items are to be considered artifacts and which astronauts are now granted ownership rights.
The legislation establishes the applicable artifacts as any equipment that was "not expressly required to be returned" to NASA at the completion of the mission, whether it was meant to be disposable, like a toothbrush, or was intended to be discarded on the moon, such as Mitchell's camera.
The bill doesn't apply to the mementos astronauts brought from Earth to fly as souvenirs in their personal preference kits, and it explicitly excludes "lunar rocks and other lunar material."
Nor are artifacts or astronauts from later space programs, like the shuttle or International Space Station, eligible. The bill limits its protections to the crew members of missions that launched between the first U.S. manned spaceflight, Mercury-Redstone 3, and the Apollo-Soyuz Test Project in 1975. Separate NASA policies, established in 1999, govern the use of equipment as mementos on the space shuttle and space station. It remains unclear what status now applies to astronauts and artifacts from the shuttle missions flown between 1981 and 1998.

NEW DELHI (Reuters) - It had been a brutal August for India's Congress party: economic growth was wilting, the monsoon rains were failing and the opposition had it cornered on yet another corruption scandal.
In stepped Sonia Gandhi to revive the morale of the ruling party's lawmakers, exhorting them at a meeting to "stand up and fight, fight with a sense of purpose and fight aggressively". It was a stunningly assertive speech from the normally temperate matriarch of a dynasty that has ruled India for most of its post-independence era.
And yet few at the gathering were aware that just a week earlier she had performed an even more dramatic about-face, agreeing to a raft of economic reforms that would be unveiled on September 13 and 14.
Gandhi has no official government post, but as Congress party president and torchbearer of India's widely revered first family, she has the last word on big policy issues: and for her, social welfare has always come before liberalizing the economy.
However, more than a dozen officials and party leaders close to the secretive inner circle of the Italian-born leader told Reuters that Gandhi was persuaded of the need for urgent action to avert a repeat of the crisis that took India to the brink of bankruptcy in 1991.
"This time there was a very grim scenario," said Rashid Kidwai, a Sonia Gandhi biographer who was given an account of the arguments made over weeks by Prime Minister Manmohan Singh and his new finance minister behind the closed doors of colonial-era government bungalows in New Delhi and even on a plane journey.
"It's not that she wanted to go for all this, but it was made very clear to her that, if she didn't, there would be far more dire consequences," Kidwai said.
Sources said the trigger for the reform campaign in Asia's third-largest economy came with the return of P. Chidambaram as finance minister on August 1.
An eloquent Harvard-educated technocrat with a track record as a reformer, he replaced Pranab Mukherjee, a left-of-centre Congress stalwart who had consistently warned Gandhi against radical reforms that could cost the party votes.
"Pranab was from the old school of Indian politics," said a senior government official, who spoke on condition of anonymity. "The prime minister and the finance minister had to persuade Mrs. Gandhi that good economics was good politics."
Her acquiescence in the end led to this month's "big bang Friday" when, a day after taking an axe to costly subsidies on diesel, the government announced that the retail market would be opened to foreign supermarket chains and the bar on foreign investment in both airlines and broadcasters would be lifted.
In sum, these were the most sweeping reforms since Singh took office in 2004 and - in the space of 48 hours - they dispelled the image of a prime minister who was losing his mojo as India's high-trajectory growth faltered.
A RELUCTANT REFORMER
However, insiders say Gandhi remains instinctively wary of economic liberalization and trimming the budget deficit. For months, she had held out against cutting fuel subsidies that are aimed at the poor and the country's rural majority, fearing the impact on the Congress party's fortunes.
She only agreed when Singh and Chidambaram spelled out that new growth generated by reforms and improved investor sentiment would have a trickle-down effect and provide funds for welfare spending in time for elections due by mid-2014.
"They explained to Mrs. Gandhi that social benefits for the poor will need deep pockets," said a Congress party source who declined to be named because the discussions were confidential.
Reuters reviewed more than 30 letters written by Gandhi to the prime minister and U.S. diplomatic cables released by WikiLeaks that portray her as passionate about social issues, and attached to protecting the poor.
That means the sudden burst of reforms could be cut short if Gandhi - who Forbes magazine ranks as the world's sixth most powerful woman - sees no benefits for the rural poor on whom her party relies for votes.
Indeed, party sources said she will now focus on passing a bill on universal food security in December, a populist plan that would cost billions of dollars at a time when her government is under intense pressure to rein in spending.
"She just wants enough budgetary resources available to finance her welfare schemes," said Swapan Dasgupta, a prominent journalist and commentator who leans towards the opposition.
"She has never spoken about reforms. What she has done is make Congress think of reforms as a low priority and a political liability - she has ingrained that mindset in the party."
A request to interview Gandhi was declined.
PARAMOUNT POWER
Sonia Gandhi, 65, carries the authority of a political family that, after India won independence from Britain in 1947, drove a vision of democratic socialism to uplift the vast rural masses. With that came a mind-boggling range of controls that tied the economy down and kept it closed to global markets.
A turning point came in 1991 when a slump in exports following the collapse of the Soviet Union and a leap in oil import costs due to the Gulf War tipped the country into a balance of payments crisis.
Manmohan Singh, then finance minister, responded with shock treatment, devaluing the rupee by nearly 19 percent. So determined was he to push this through, when the prime minister of the day got cold feet, he reportedly blamed the infamous inefficiency of India's telephone system to pretend that he couldn't contact the central bank in time.
His moves to prise open the economy set the stage for a long run of dazzling growth that peaked at 9.7 percent in 2006/07.
Although Gandhi appointed Singh as prime minister when the Congress party returned to power eight years ago, she has a far more socialist mindset than the Oxford-educated economist who drove that first round of reforms.
Sources close to the Gandhi family say she has been strongly influenced by her late mother-in-law, former prime minister Indira Gandhi, whose policies were considerably left of centre.
Sonia Gandhi initially declined the throne of the Congress party after the 1991 assassination of her husband and former prime minister, Rajiv, but she finally agreed to enter politics six years later to lift the flagging fortunes of the party under her family's brand name.
As party president and chairperson of the ruling coalition, she has kept a low and almost enigmatic profile, appearing to stand above the political fray. When she went abroad for surgery last year there was no official word on her illness, and the media tamely accorded her the privacy a royal might expect.
But Gandhi wields extraordinary power behind the scenes, shaping policy out of the public eye with a tight circle of decision-makers and relying on back-channel negotiations to manage relations with fractious coalition allies
Ratings agency Standard & Poor's, warning earlier this year that India could become the first of the emerging market BRICS economies to lose its investment-grade rating, took a swipe at her resistance to policies mooted by Singh.
"The Congress party is divided on economic policies. There is substantial opposition within the party to any serious liberalization of the economy," S&P said.
"Moreover, paramount political power rests with the leader of the Congress party, Sonia Gandhi, who holds no cabinet position, while the government is led by an unelected prime minister ... who lacks a political base of his own."
A BENEVOLENT MATRIARCH
Gandhi gives little away about her thinking on economic policy, but dispatches from the U.S. embassy in New Delhi during the early years of Singh's tenure show she made "repeated objections" to proposed hikes in fuel prices, which are heavily subsidized to cushion the poor.
"Key leaders (including Sonia Gandhi) have opposed the price hikes, criticized the way they have been handled, or urged Congress to capitulate to ... demands for a 'rollback', and the party is finding it difficult to speak with one voice," one of the cables said.
Describing a leader who projects herself as a benevolent matriarch, the dispatches were scathing about one of her pet projects, a scheme guaranteeing 100 days of paid employment per year for rural citizens. "At worst, the jobs plan is political patronage run amok and horrid economic policy," one said.
Gandhi also set up the National Advisory Council, a government-funded think tank that offers legislative guidance on social policy and the rights of disadvantaged groups.
A batch of letters Gandhi wrote as chairperson of the council, which were recently released under the Right to Information Act, illustrate where her priorities lie.
Writing to the prime minister and several ministers, she drew their attention to issues such as legal entitlement to subsidized foodgrains, child labor, housing for the poor and "indiscriminate acquisition" of agricultural land for private companies. In one letter, she closed by urging a minister: "You may like to have the matter examined appropriately".
WARNINGS OF IMPENDING CRISIS
How was Gandhi persuaded that, as one government official put it, "if you are not growing you are distributing poverty"?
For one thing, the economy was in trouble. Growth had dropped to its lowest clip in three years, the fiscal deficit was blowing past official targets, and the government was under heavy fire for sitting on its hands as the crisis mounted.
With Mukherjee gone from the Finance Ministry, Singh and Chidambaram made their move, warning Gandhi of a possible slump in the rupee and even a repeat of 1991, sources said.
"There were three meetings over about four weeks ... to tell her that if we don't do all this it will be bad politics," said the senior government official.
Singh also tackled Gandhi at length on the issue in July during a flight from Delhi to the northeastern state of Assam.
Adding his voice at a separate meeting, Commerce Minister Anand Sharma explained to Gandhi that opening up to global supermarkets like Wal-Mart Stores Inc could tame the corruption that plagues the state-run food distribution network - a compelling argument after two years of graft scandals that have damaged her government.
When Gandhi returned in September from a medical check-up abroad, the stage was set for 'big bang Friday'.
And although the reforms triggered the walkout of a key coalition partner from the government, reducing it to a minority, she has resisted calls for a U-turn and even plans to join a street march in favor of the retail sector reform.
Gandhi's ambition in all this is to ensure that the Congress party returns to power in 2014, with her son - Rahul - at the helm of the government after eight years waiting in the wings.
"What she is concentrating on is really the need to be re-elected," said M.J. Akbar, a former Congress party lawmaker and once a trusted Gandhi family insider. "The only thing wrong about this reforms business though is ... they left it too close to the election."

While Albert Einstein's genius isn't included, an exclusive iPad application launched Tuesday promises to make detailed images of his brain more accessible to scientists than ever before. Teachers, students and anyone who's curious also can get a look.
A medical museum under development in Chicago obtained funding to scan and digitize nearly 350 fragile and priceless slides made from slices of Einstein's brain after his death in 1955. The application will allow researchers and novices to peer into the eccentric Nobel winner's brain as if they were looking through a microscope.
"I can't wait to find out what they'll discover," said Steve Landers, a consultant for the National Museum of Health and Medicine Chicago who designed the app. "I'd like to think Einstein would have been excited."
After Einstein died, a pathologist named Thomas Harvey performed an autopsy, removing the great man's brain in hopes that future researchers could discover the secrets behind his genius.
Harvey gave samples to researchers and collaborated on a 1999 study published in the Lancet. That study showed a region of Einstein's brain ? the parietal lobe ? was 15 percent wider than normal. The parietal lobe is important to the understanding of math, language and spatial relationships.
The new iPad app may allow researchers to dig even deeper by looking for brain regions where the neurons are more densely connected than normal, said Dr. Phillip Epstein, a Chicago-area neuroscientist and consultant for the museum.
But because the tissue was preserved before modern imaging technology, it may be difficult for scientists to figure out exactly where in Einstein's brain each slide originated. Although the new app organizes the slides into general brain regions, it doesn't map them with precision to an anatomical model.
"They didn't have MRI. We don't have a three-dimensional model of the brain of Einstein, so we don't know where the samples were taken from," said researcher Jacopo Annese of the Brain Observatory at the University of California, San Diego. What's more, the 1-inch-by-3-inch Einstein slides on the app represent only a fraction of the entire brain, Annese said.
Annese has preserved and digitized another famous brain, that of Henry Molaison, who died in 2008 after living for decades with profound amnesia. Known as "H.M." in scientific studies, Molaison participated during his life in research that revealed new insights on learning and memory.
A searchable website with images of more than 2,400 slides of Molaison's entire brain will be available to the public in December, Annese said.
"There will be another Einstein and we'll do it like H.M.," Annese predicted. For now, he said, it's exciting that the Einstein brain tissue has been preserved digitally before the slides deteriorate or become damaged. The app will spark interest in the field of brain research, just because it's Einstein, he said.
"It's a beautiful collection to have opened up to the public," Annese said.
Some may question whether Einstein would have wanted images of his remains sold to non-scientists for $9.99.
"There's been a lot of debate over what Einstein's intentions were," museum board member Jim Paglia said. "We know he didn't want a circus made of his remains. But he understood the value to research and science to study his brain, and we think we've addressed that in a respectful manner."
Paglia said the app could "inspire a whole new generation of neuroscientists."
Proceeds from sales will go to the U.S. Department of Defense's National Museum of Health and Medicine in Silver Spring, Md., and to the Chicago satellite museum, which is set to open in 2015 with interactive exhibits and the museum's digital collections.

Trouble outside the floodgates of New Orleans
NEW ORLEANS ? Hurricane Isaac may have proved a successful test for the 840,000 people inside the New Orleans hurricane protection system ? 133 miles of levees, floodgates and walls that surround the city and portions of four parishes like a fortress. But the storm highlighted the vulnerability of more than 200,000 people just beyond the system.
As of last week, an estimated 13,000 homes were reported flooded in Louisiana, most just outside the $14.5-billion federal levee system rebuilt around New Orleans after Hurricane Katrina. Experts estimate that total insured on-shore damages from the Category 1 storm could reach $1.5 billion. That's somewhat less than the roughly $2 billion in damage caused by Hurricane Gustav in 2008.
Local and state lawmakers are lobbying the U.S. Army Corps of Engineers to extend hurricane protection beyond the existing New Orleans system. They hope that the contrast between Isaac's effects on the haves and the have-nots ? that is, the urban areas inside the levee system and the rural areas outside it ? will lead to more equal treatment.
Residents and officials of areas with the most Isaac-related flooding ? Jefferson, Plaquemines, St. John the Baptist and St. Tammany parishes ? are pushing for taller levees, new barrier walls, floodgates and pumping stations. In Jefferson, the most significant project would be a planned 16-foot-high, 28-mile-long ring levee that would protect 3,000 homes, including many belonging to people who have lived there for generations.
But Steven Stockton, the Army Corps' deputy director of civil works, says the corps faces a $60-billion backlog in projects already authorized by Congress ? and only $2 billion a year for projects nationwide. The projects most likely to win funding must promise benefits that outweigh construction and maintenance costs at least 2 to 1.
"In a rural, less populated area, you just don't generate the benefits," Stockton said.
Emphasizing that the corps has to keep in mind the best interests of all taxpayers, he asked: "Should a taxpayer in Iowa be subsidizing someone's risky behavior in southern Louisiana if they want to live in a flood plain?"
Jean Lafitte Mayor Tim Kerner says his Jefferson Parish town, among the communities flooded during Isaac, is a cultural treasure that merits hurricane protection. Built by French and Spanish settlers, it's named after a French pirate who helped fight off a British attack on New Orleans.
The ring levee that he and other officials are pushing is a scaled-back version of a nearly $1-billion project that Congress authorized but that the corps canceled. The larger project wasn't worth the expense, corps officials concluded, noting that one study had estimated the average annual storm damage in the area at $15 million to $22 million ? compared with the levee's annual construction and maintenance costs of $67 million to $75 million.
"Right now, if we were treated as second-class citizens, it would be an improvement," Kerner said.
He and others resent being excluded from the federal levee system. Stoking their anger is one of the grandest post-Katrina improvements in the system: the Gulf Intracoastal Waterway West Closure Complex, a $1-billion series of flood walls, gates and pumps on the Intracoastal Waterway just north of Jean Lafitte.
Billed as the largest pumping station in the world, the complex was designed by the Corps of Engineers to protect the west bank of New Orleans. When it was used for the first time during Isaac, the complex did just that ? even as Jean Lafitte flooded.
"We knew it was going to happen, and it's going to happen over and over again," Kerner said. "We are happy for them, but not at our expense."
Some complain the levee system worsened flooding outside the protection zone, which corps officials dispute. Even if the system did direct water toward other communities, they say, the amount was minuscule compared with storm surge and rain.
Outside Lafitte Town Hall this month, fisherwoman Tina Wertz, 47, of nearby Barataria and her 13-year-old daughter, Hailey, ate boxed lunches and tried not to think about their home, inundated with 7 feet of water.
"They pick and choose," she said of corps officials' decision to limit hurricane protection. "We pay our taxes just like they pay their taxes. They put up a wall to protect them and not us. They're waiting for us to wash away."
The ring levee has the support of New Orleans Mayor Mitch Landrieu and the state's U.S. senators. Said Jefferson Parish President John Young: "Look at all the money FEMA had to put out with Isaac, Rita, Ike. This is not just important to these communities ? it's important to the nation."
He and other local officials have persuaded state lawmakers to include the ring levee in the first phase of Louisiana's $50-billion, 50-year coastal restoration plan that would be paid for with the BP-funded Restore Act and the state's share of gulf oil revenue.
But it remains to be seen whether, and when, BP will pay. Once work starts, the ring levee could take a decade to complete, officials said.
A few days after Isaac had passed, Chris Gilmore, a corps senior project manager who helped rebuild the levee system after Katrina, inspected the southeastern barrier, near where it bisects Plaquemines Parish.
The area was littered with desiccated mullet, brown marsh grass and other storm debris, but the 32-foot-high steel floodgate and 26-foot-high concrete wall had held.
"Right here you would have had 14 feet of water. You would have been underwater," he said. "Look at what Isaac did to this system ? it performed exactly as it was designed to."
To the south, Plaquemines Parish was devastated, its shorter levees overtopped from both sides. Two people drowned.
But Plaquemines, unlike Jefferson, is getting $1.4 billion in hurricane protection improvements from the corps, quadrupling the size of its levees. That project, approved by Congress immediately after Katrina, was not subject to the same rigorous cost/benefit analysis as the Jefferson ring levee proposal, according to the corps' Stockton.

Open houses are a thing of the past. They made sense when properties for sale where not easily?accessible?to buyers and when agents where using printed property directories to find properties for their clients. Those days are gone. Nowadays, buyers do not need an agent to find them a property. Buyers can (and like) to search and find properties for sale on their own. The truth is that the most important job of a real estate agent is not to find a property to their buyers and to find a buyer to their sellers.?Why not?
Because buyers need an agent to:
- conduct a market analysis to ensure that sales price is no higher than the market value price,
- write up an offer, to negotiate the terms of the contract, to negotiate repairs after inspection was completed,
- ensure that the required documents the contract dictates if provided to the buyers within the prescribed time frame.
And because sellers need an agent to:
- help them prepare the property for sale -decluttering, repairs and staging-,
- conduct a market analysis to price the property at a market value price,
- market the property online -property description, pictures and mandated listing documents-,
- negotiate the offers that come in, the negotiate repairs after inspection was completed,
- ensure that all of the required documents are completed as the contract dictates.
In summary, buyers and sellers need a licensed real estate professional to guide and protect them from the time they have their first contact to the day the transaction is closed.
Another important piece of information I have been disclosing to my sellers is that open houses are not done with the goal of?selling?that particular property. I let my sellers know that the real beneficiary of an open house is going to be me. I also let my sellers know that most of the open house attendees are going to be?their?curious?neighbors and people that are driving around the neighborhood.?If you are selling or considering to sell your property, you need to know this.
See, the truth of the matter is that agents conduct open houses to market themselves (and their broker) AND to ?convert? unrepresented buyers into their clients. Open houses are a way for agents to expand their data base to then expand their business. And they do. I heard it first-hand how new agents, especially new-to-town-agents built their data base and got a few new clients by doing open houses when they started?their?business and?their?business was ?slow?. In fact, a previous broker of mine mandated that I and all the other new agents completed a ?New Agents Training? in which a class on how to take advantage of open houses was taught to all of us as a tool to expand our client base and find new buyers.
So, now you know who the real beneficiary of an open house is and since you like your agent so much, you are still considering allowing him/her to do open houses to help them grow their business. Your are still thinking ?It doesn?t hurt me and maybe, just maybe, a buyer may fall in love with my house at the open house and buy it?. Not so true?
In Texas at least, visitors of an open house are not mandated, nor they are asked, to provide a valid picture ID before they enter into an open house. Most agents holding an open house have a sign-in sheet asking for visitors to register with their name and a phone number or email and ? that?s it. Most visitors register with a fake name and they are in the house. No questions asked.
Once the visitor ?registered?, s/he is allowed to roam the property at their own will while the agent sits either in the kitchen or living area greeting other visitors or doing some personal work -updating?their?database, writing Thank-You notes and the like.
Alright. If you having figure it out yet, let me tell you what some of the dangers are by having strangers roaming your property at their leisure:
- They can be?studying?your property for a future break-in by taking account of the existence and location of a security system, windows, visibility of back door, etc.
- They may take with them some of your belongings: jewelry and medicine are the most sought-after items.
- They may be studying your family profile by the pictures you have displayed and the clothing in your closets: ?This looks like a adult-female and two young children home? my buyers recently commented when I showed them a property.
I personally think that the marketing strategies some agents are using to capture more listings -such as offering open houses as a marketing tool to ?benefit? the seller- are not only deceitful but unethical. Article 1 of the ?Code of Ethics and Standards of Practice of the National Association of REALTORS?? states:
??When representing a buyer, seller, landlord, tenant, or other client as an agent, REALTORS? pledge themselves to protect and promote the interests of their client. This obligation to the client is primary, but it does not relieve REALTORS? of their obligation to treat all parties honestly. When serving a buyer, seller, landlord, tenant or other party in a non-agency capacity, REALTORS? remain obligated to treat all parties honestly. (Amended 1/01)?
